Honolua as a whole has been and will contiune to be a uch discussed area as the managelemt and future of this are is defined. One of the areas that raise concer of course are all those homes up on the hill. The peoepel who bought those homes are in many ways victims just like us. Fortunate for them they have their title companies to turn to, oh we can turn to them as well! 

We would like to work out a solution for each “owner” in this area on an individual basis. They do not own the land beneath their houses but we do not want to “kick them out”  We have some options and are willing to discuss and explore with them all possible solutions and find one that works for both parties. Two seperte letters have been sent to these homeowners. Only 4 responsded. Can you beleive that?  Is it a matter of disbelief or arrogance?

Aloha;

My name is Donna Lanakila Willard and I am the Executor of the Pinehaka Trust.

This letter is in regards to lands you purchased in Honolua identified by tax map key numbers :   

and by site address  

When Maui Land and Pineapple Company originally sold these properties they did not have title to them or at any other time. They knowingly developed and sold these properties with no title or legal ownership. This action means that every title they transferred is faulty and not clear and makes the sale null and void.

We have been in discussions with them since early November. During these meetings, we asked them to furnish their title and claim to ownership. Their attorney Caroline Belsom and Land Manager Kalani Ho referred to a document that they registered with the Bureau of Conveyances (Hall of Records) and is recorded in Book number 115 on page  60. The deed mentions several parcels of property but not the ahupua’a of Honolua.  That document is included for your review.

As the true heirs and rightful owners of this property we are informing you we have every intention of reclaiming all our land in the ahupua’a of Honolua. We would like to work with you to resolve this situation. This land is not for sale today or in the future.

The Department of Land and Natural Resources Division and other relative agencies, including the Governor’s office have been notified of the situation and our actions.

We hope you understand that we are correcting a wrong that was done to both you and our family, collectively and we desire to find a resolution that will be feasible to both parties.

A reply within 15 business days will allow us to begin resolving this matter in a timely manner. We look forward to hearing from you.

2nd letter

 March 22, 2010

 Aloha;

 I am writing in regards to the letter sent to you on January 17, 2010. In that letter you were notified of the questionable validity of your title to the parcel in Honolua that is identified by tax map key  .

 In that letter, we informed you of our claims to this land and we provided you with a copy of the deed Maui Land and Pineapple uses as its claim to title. If you have taken the time to read that document you will have seen that this deed does not convey title or ownership to lands in Honolua.

 As we have not yet received a reply from you we are, either assuming that you do not take our claim seriously or you are not interested in working with us to resolve this matter in a manner that is beneficial to both you and our family.

 Therefore, we are informing you that we are preparing to move into a court of law to resolve our claims to ownership.

 A Notice to Correct Title has been registered in an effort to alert potential buyers of our claims and the existing conflict.

 As always, we are open for discussion and dialogue regarding this matter. Please be aware that our claim is not a sovereign move but one based on fact and law.
